In order to be commissioned as a Notary Public in the state of California, the applicant must:
  • Be a legal California resident.
  • Complete a mandatory course of study approved by the California Secretary of State.
  • Pass a written examination prescribed by the California Secretary of State.
  • Clear a security check, which includes fingerprinting and a criminal background check.
California commissions notary publics to serve the public as impartial witnesses in taking acknowledgements, administering oaths and affirmations, and by authenticating signatures on contracts, deeds, trusts, loans, and other legal documents.

The National Notary Association (NNA) is the nation's professional notary association, founded in 1964. Its predecessor organization, the California Notary Assocation, became a unit within the new National Notary Association when the national association was formed. The National Notary Association attracted members who wanted a complete education in the basics of notarization and also wanted to be kept up-to-date on new state laws and regulations affecting their duties. The NNA came to be the source for state officials wanting help in modernizing their outdated notary laws. The National Notary Association collaborated with Yale Law School to create the Model Notary Act, first published in 1973 and updated in 1984 and 2002. This Act has had a great influence on state laws and on the practice of notary publics throughout the United States. The NNA's Notary Public Code of Professional Responsibility, published in 1998 and now recognized as the U.S. Notary's code of ethics, has also come to be very influential throughout the United States.
